Terms of Service

These Terms of Service (“Terms”) govern your use of the BCL-ElParcero Painting website and services. By using our services, you agree to these Terms.

1. Services Provided

BCL-ElParcero Painting provides professional residential and commercial painting services in the Atlanta, Georgia metropolitan area, including but not limited to:

  • Interior and exterior house painting
  • Deck staining and sealing
  • Fence painting
  • Cabinet refinishing
  • Surface preparation and minor repairs
  • Color consultation

2. Service Area

Our primary service area includes Atlanta and surrounding communities within a 25-mile radius. Service outside this area may be available with additional travel charges.

3. Estimates and Quotes

Free Estimates

  • All estimates are provided at no charge
  • Estimates are valid for 30 days from the date provided
  • Estimates are based on information provided and visual inspection
  • Final pricing may vary if conditions differ from initial assessment

Written Quotes

  • All approved projects will have a written contract/quote
  • Quotes include detailed scope of work, materials, and pricing
  • Changes to the scope of work may result in additional charges
  • Customer approval is required for any changes exceeding $100

4. Payment Terms

Payment Methods

We accept the following payment methods:

  • Cash
  • Check (personal or business)
  • Credit/debit cards (via Stripe)
  • Online payments through our secure payment system

Payment Schedule

  • Projects under $1,000: Full payment upon completion
  • Projects $1,000-$5,000: 50% deposit, balance upon completion
  • Projects over $5,000: 30% deposit, progress payments as agreed, final payment upon completion
  • Payment plans: Available for qualifying projects over $2,500

Late Payments

  • Payment is due upon completion unless other arrangements are made
  • Late fees of 1.5% per month may apply to overdue balances
  • Collections costs and reasonable attorney fees may be charged for delinquent accounts

5. Scheduling and Timeline

Project Scheduling

  • Start dates are estimated and subject to weather and material availability
  • We will provide reasonable notice for any schedule changes
  • Customer must provide access to property as scheduled

Weather Delays

  • Exterior work may be delayed due to weather conditions
  • Interior work generally continues regardless of weather
  • No penalty for weather-related delays

Customer Delays

  • Customer-requested delays may affect scheduling and pricing
  • Storage fees may apply for materials if project is significantly delayed

6. Materials and Workmanship

Paint and Materials

  • We use high-quality paints from reputable manufacturers
  • Specific paint brands/products will be specified in written quotes
  • Customer may request specific materials (additional costs may apply)
  • We are not responsible for discontinued colors or products

Workmanship Warranty

  • We warrant our workmanship for 2 years from completion date
  • Warranty covers defects in application, not normal wear and tear
  • Warranty repairs will be completed at no charge during normal business hours
  • Warranty is void if surfaces are altered by others

Material Defects

  • Material defects are covered by manufacturer warranties
  • We will facilitate warranty claims with manufacturers
  • We are not responsible for manufacturing defects beyond facilitation

7. Property Protection and Liability

Property Protection

  • We will protect floors, furniture, and landscaping during work
  • Customer should remove or protect valuable/fragile items
  • We are not responsible for items not properly protected or disclosed

Liability Insurance

  • We carry general liability insurance
  • Insurance information available upon request
  • Customer should verify coverage limits meet their requirements

Property Damage

  • Any damage caused by our negligence will be repaired or compensated
  • Pre-existing damage should be noted before work begins
  • Customer must notify us of any damage within 48 hours of discovery

8. Customer Responsibilities

Property Access

  • Provide safe, unobstructed access to work areas
  • Ensure utilities (water, electricity) are available as needed
  • Secure pets during work hours

Property Preparation

  • Remove personal items from work areas
  • Protect or remove fragile items
  • Notify us of hazardous conditions (lead paint, asbestos, etc.)

Color Selection

  • Final color approval is customer’s responsibility
  • We recommend testing colors before final application
  • Color variations due to lighting or surface conditions are not defects

9. Changes and Cancellations

Scope Changes

  • All changes must be approved in writing
  • Additional work will be charged at agreed rates
  • Changes may affect timeline and scheduling

Cancellation Policy

  • Projects may be cancelled before work begins with 24-hour notice
  • Cancellation after work begins may result in charges for completed work and materials
  • Deposit refunds will be made within 30 days of cancellation

10. Lead Paint and Hazardous Materials

EPA Compliance

  • We comply with EPA lead-safe work practices when required
  • Pre-1978 homes may require special procedures
  • Additional charges may apply for lead-safe work practices

Hazardous Materials

  • Customer must disclose known hazardous materials
  • We may decline work involving hazardous materials
  • Specialized remediation is not included in standard painting services

11. Limitation of Liability

Service Limitations

  • Our liability is limited to the cost of services provided
  • We are not liable for indirect, consequential, or incidental damages
  • Total liability will not exceed the contract amount

Force Majeure

  • We are not liable for delays due to circumstances beyond our control
  • This includes weather, natural disasters, government actions, or supplier delays

12. Dispute Resolution

Governing Law

  • These Terms are governed by Georgia state law
  • Any disputes will be resolved in Georgia courts

Resolution Process

  1. Direct communication with project manager
  2. Management review and resolution attempt
  3. Mediation if necessary
  4. Legal action as last resort
